Privacy Notice & Website Terms

These Privacy Notice & Website Terms (“Terms”) apply to sompp.com, ShitOnMyProjectPlease.com, and any related domain that redirects to or displays the same website (the “Site”).

The Site is operated by Evgenii Volkov, an individual operating from Kuala Lumpur, Malaysia (“I”, “me”, or “my”).

By accessing the Site, using its content, following its links, or submitting information or materials, you confirm that you have read and accepted these Terms. If you do not agree, do not use the Site or submit any information.

The Site is intended primarily for founders, investors, executives, advisers, and other persons acting in a business or professional capacity.

Part I — Privacy Notice

2. Information I may collect

I may collect the following information:

  • your name;
  • your email address and other contact details;
  • your professional role, company, or project affiliation;
  • a public project deck URL;
  • a PDF or other material that you voluntarily submit;
  • information contained in your deck or subsequent communications;
  • correspondence, meeting records, proposals, NDAs, contracts, invoices, and payment records;
  • technical information such as IP address, browser type, device information, referral URL, approximate location, timestamps, security signals, and website activity;
  • information necessary to detect spam, abuse, fraud, malware, or security threats.

Please do not submit passwords, access credentials, source code, government identifiers, financial account information, medical information, biometric data, information about children, personal data belonging to third parties, or any other sensitive or regulated information.

3. Public and non-confidential materials only

The initial submission stage is intended for a public deck or a non-confidential PDF.

Do not submit trade secrets, proprietary research, confidential financial information, non-public architecture, customer data, personal data belonging to third parties, or other information requiring contractual confidentiality.

Submitting a file, link, email, or message does not create an NDA, confidentiality obligation, fiduciary duty, advisory relationship, or professional engagement.

A confidentiality label, footer, watermark, email legend, or similar notice included in submitted material does not create an NDA or modify these Terms.

If I wish to review confidential materials, a separate written NDA may be signed before those materials are shared.

4. How I use information

I may use information to:

  • review your initial submission;
  • decide whether I am interested in the project and whether I may be useful;
  • communicate with you;
  • request additional context;
  • arrange an NDA, meeting, proposal, audit, or advisory engagement;
  • define scope, timing, fees, and deliverables;
  • administer contracts, scheduling, payments, and accounting;
  • provide agreed professional services;
  • operate, secure, maintain, analyse, and improve the Site;
  • prevent spam, fraud, abuse, malware, and security incidents;
  • establish, exercise, or defend legal claims;
  • comply with legal, regulatory, tax, accounting, or law-enforcement requirements.

I do not sell personal data. I do not use project submissions for unrelated advertising. I will not send marketing messages unless you separately request or consent to them.

5. Legal grounds for processing

Depending on the circumstances and applicable law, I may process information because:

  • you asked me to take steps before entering into a contract;
  • processing is necessary to perform or administer a contract;
  • I have a legitimate interest in evaluating enquiries, operating and protecting the Site, communicating with potential clients, preventing abuse, and maintaining business records;
  • you have provided consent where consent is required;
  • processing is necessary to comply with a legal obligation;
  • processing is necessary to establish, exercise, or defend legal claims.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that took place before withdrawal.

6. Service providers and recipients

I may share information only where reasonably necessary with service providers and professional advisers, including providers of:

  • website hosting and content delivery;
  • website security and bot protection;
  • form processing and file storage;
  • CRM and enquiry management;
  • email and cloud productivity services;
  • scheduling and video conferencing;
  • electronic signatures;
  • payment processing;
  • accounting, legal, tax, insurance, and professional advice;
  • analytics and technical monitoring.

These providers may include services such as Cloudflare, HubSpot, Calendly, Stripe, and their successors or replacements, depending on which services are active at the relevant time.

Third-party providers process information under their own terms and privacy notices. I am not responsible for the independent privacy, security, availability, or business practices of third-party providers except to the extent required by applicable law.

I may also disclose information:

  • when required by law, regulation, court order, or lawful government request;
  • to protect my rights, property, security, or legitimate interests;
  • to investigate suspected fraud, abuse, or unlawful activity;
  • in connection with a transfer, restructuring, or sale of all or part of the relevant business activity;
  • with your instructions or consent.

7. International transfers

The Site is operated internationally. Information may be processed in Malaysia, the United States, the European Economic Area, the United Kingdom, or other countries in which service providers operate.

Those countries may have data-protection rules different from those in your country. Where required, I will rely on legally recognised transfer mechanisms or other appropriate safeguards.

By submitting information, you acknowledge that international processing may be necessary to evaluate your enquiry and provide the requested services, subject to any rights that cannot legally be waived.

8. Retention

I retain information only for as long as reasonably necessary for the purposes described in these Terms.

As a general practice:

  • an uploaded deck that does not lead to further discussions may be deleted within 90 days;
  • enquiry and contact records may be retained for up to 12 months;
  • materials connected to an active or potential engagement may be retained for the duration of the engagement and a reasonable period afterwards;
  • contracts, invoices, payment records, and legally relevant communications may be retained for the period required by tax, accounting, insurance, and applicable law, which may be up to seven years or longer where legally necessary;
  • security logs and backups may be retained according to the normal retention cycles of the relevant service provider.

Information may be retained longer where reasonably necessary to establish, exercise, or defend legal claims, investigate abuse, enforce these Terms, or comply with law.

9. Cookies, analytics, and security technology

The Site may use cookies, local storage, security tokens, pixels, or similar technologies that are necessary to:

  • deliver the Site;
  • protect forms from automated abuse;
  • maintain security;
  • measure aggregated website usage;
  • understand whether the Site and submission process are functioning correctly.

Cloudflare Turnstile or a similar service may process technical and security information to distinguish legitimate users from automated traffic.

If non-essential advertising, profiling, or analytics cookies are introduced, additional consent controls may be provided where required by law.

You may restrict cookies through your browser, but doing so may prevent parts of the Site or submission form from functioning.

10. Security

I use reasonable administrative and technical measures intended to protect information.

However, no website, email, file upload, cloud service, or internet transmission is completely secure. I do not guarantee that information will never be lost, corrupted, intercepted, disclosed, accessed without authorisation, or affected by a security incident.

You submit information over the internet at your own risk. Do not submit confidential or sensitive information before an appropriate written agreement and secure communication method have been established.

11. Your data-protection rights

Depending on your location and applicable law, you may have the right to:

  • request access to personal data held about you;
  • request correction of inaccurate or incomplete information;
  • request deletion;
  • restrict or object to certain processing;
  • withdraw consent;
  • request a portable copy of certain information;
  • complain to an applicable data-protection authority.

These rights may be subject to legal exceptions, verification of identity, record-retention duties, and the need to establish, exercise, or defend legal claims.

Requests should be sent to canyou@sompp.com. I may request reasonable information to verify your identity and locate the relevant records.

There is no solely automated decision-making that produces legal or similarly significant effects. Decisions about whether to review or accept a project are made at my discretion.

12. Children

The Site is not intended for persons under 18 years of age. Do not submit information concerning a child.

If I learn that personal data belonging to a child was submitted without an appropriate legal basis, I may delete it.

Part II — Website Terms

13. No professional relationship

Accessing the Site, reading its content, submitting a deck, receiving a reply, or participating in preliminary correspondence does not create:

  • a client relationship;
  • an adviser-client relationship;
  • an employment relationship;
  • a partnership or joint venture;
  • a fiduciary duty;
  • an agency relationship;
  • an obligation to accept or continue discussions;
  • an obligation to provide services;
  • an NDA or confidentiality obligation.

A professional engagement exists only after the scope, fee, and applicable terms have been agreed in a separate written engagement agreement.

If these Terms conflict with a separately signed agreement, the signed agreement controls for the subject matter of that engagement.

14. No obligation to accept a project

I may accept, reject, ignore, discontinue, or decline any enquiry or project at my sole discretion, with or without explanation.

Any stated response time is a target, not a guarantee. I am not responsible for a missed, delayed, filtered, undelivered, or unanswered submission.

Submitting a project does not reserve time, create priority, guarantee a meeting, or oblige me to review the material.

15. No advice and no guarantee of results

The Site provides general information about independent project risk audits. Its content is not legal, financial, investment, tax, accounting, regulatory, cybersecurity, engineering, medical, or other regulated professional advice.

Nothing on the Site should be treated as a recommendation to invest, raise capital, launch, stop, build, buy, sell, hire, terminate, enter a market, or make any other decision.

You remain solely responsible for:

  • your project;
  • your assumptions;
  • your research;
  • your decisions;
  • your legal and regulatory compliance;
  • your security;
  • your finances;
  • your contracts;
  • your technology;
  • your operations;
  • your choice of advisers and specialists;
  • the consequences of acting or not acting.

An audit identifies questions, uncertainties, assumptions, dependencies, and potential risks. It does not eliminate risk and does not guarantee that a project will succeed, avoid losses, obtain funding, operate securely, or comply with applicable law.

16. Submitted materials

By submitting material, you confirm that:

  • you have the right and authority to submit it;
  • doing so does not violate an NDA, contract, law, intellectual-property right, privacy right, or duty owed to another person;
  • it contains no malware, malicious code, unlawful material, or unauthorised personal data;
  • it is public or non-confidential unless a separate written NDA is already in effect;
  • the information is not deliberately false, misleading, or impersonating another person;
  • you are acting in a legitimate business or professional capacity.

You retain ownership of your submitted material.

You grant me a non-exclusive, worldwide, royalty-free, limited licence to access, download, copy, store, process, and share the material with relevant service providers or professional advisers solely as reasonably necessary to evaluate the submission, communicate with you, protect the Site, comply with law, or prepare a potential engagement.

You may request deletion, subject to applicable legal rights and retention obligations.

17. Intellectual property

Unless stated otherwise, the Site’s text, design, branding, graphics, layout, code, downloadable materials, and other original content are owned by or licensed to Evgenii Volkov.

“SOMPP”, “Shit On My Project Please”, associated branding, and the Site’s presentation may not be copied, reproduced, republished, scraped, sold, licensed, or used to create a confusingly similar service without prior written permission.

You may view and share links to publicly available pages for legitimate, non-commercial purposes. No other licence is granted.

18. Acceptable use

You must not:

  • interfere with the Site or attempt unauthorised access;
  • bypass security, rate limits, bot protection, or access controls;
  • upload malware or harmful code;
  • submit fraudulent, abusive, unlawful, or misleading material;
  • use automated systems to overload, probe, or scrape the Site;
  • impersonate another person;
  • use the Site to violate law or third-party rights;
  • attempt to identify vulnerabilities without prior written permission;
  • submit content primarily to create legal, operational, or reputational harm.

I may block access, remove submissions, preserve evidence, or report suspected unlawful conduct.

19. Third-party services and links

The Site may contain links to LinkedIn, scheduling services, payment processors, document providers, video-conferencing platforms, or other third-party services.

Third-party services are provided independently. I do not control and do not endorse or guarantee their content, availability, security, accuracy, privacy practices, or performance.

Your use of a third-party service is governed by its own terms. You use third-party services at your own risk.

20. Website availability and changes

I may change, suspend, restrict, or discontinue any part of the Site without notice.

I do not guarantee that:

  • the Site will always be available;
  • content will be current, complete, or error-free;
  • links will work;
  • files or submissions will be preserved;
  • the Site will be free from malware, vulnerabilities, interruptions, or compatibility problems;
  • errors will be corrected;
  • any particular browser, device, region, or network will be supported.

21. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site, its content, forms, communications, and related functionality are provided “as is” and “as available”, without any express, implied, statutory, or other warranty.

I disclaim all warranties and representations, including warranties of:

  • accuracy;
  • completeness;
  • timeliness;
  • reliability;
  • availability;
  • security;
  • merchantability;
  • satisfactory quality;
  • fitness for a particular purpose;
  • non-infringement;
  • professional outcome;
  • commercial success.

No statement on the Site or in preliminary correspondence creates a warranty or guarantee.

22. Limitation of liability

To the fullest extent permitted by applicable law, Evgenii Volkov will not be liable for any loss, damage, claim, cost, or expense arising from or connected with:

  • access to or inability to access the Site;
  • reliance on Site content;
  • a submission, uploaded file, public link, or communication;
  • acceptance or rejection of a project;
  • delayed or missing replies;
  • unauthorised access, data loss, corruption, interception, or a security incident;
  • third-party services, links, platforms, or service providers;
  • any decision made or not made using information from the Site;
  • any project, investment, product, technical, operational, financial, or business outcome.

I will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profits, revenue, investment, opportunity, business, contracts, goodwill, reputation, expected savings, or data, even if advised that such loss was possible.

If liability cannot legally be excluded, my total aggregate liability arising from or related to the Site, its content, or an initial submission will not exceed USD 100.

Any liability relating to a paid audit or advisory engagement will be governed exclusively by the separately signed engagement agreement.

Nothing in these Terms excludes or limits liability to the extent that exclusion or limitation is prohibited by applicable law.

23. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Evgenii Volkov from claims, liabilities, damages, losses, penalties, costs, and reasonable professional fees arising from:

  • your submitted material;
  • your violation of these Terms;
  • your violation of law;
  • your infringement of another person’s rights;
  • your unauthorised disclosure of confidential or personal information;
  • any false representation made by you.

This section does not apply to the extent prohibited by mandatory consumer law.

24. Governing law and disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules.

Before starting formal proceedings, you agree to contact me and make a reasonable good-faith attempt to resolve the dispute.

Subject to any mandatory rights that cannot legally be waived, the courts located in Kuala Lumpur, Malaysia will have exclusive jurisdiction over disputes arising from the Site or these Terms.

If you use the Site as a consumer, nothing in these Terms removes mandatory protections or jurisdictional rights granted to you by applicable consumer law.

25. Changes to these Terms

I may update this document when the Site, submission process, service providers, business practices, or applicable requirements change.

The current version will be published on the Site with an updated date. Changes apply from publication unless a later date is stated.

Continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by law.

26. Severability and entire agreement

If any provision is found invalid, unlawful, or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

Failure to enforce a provision is not a waiver.

These Terms constitute the entire agreement concerning use of the Site and initial project submissions, except where a separate written agreement applies.

27. Final acknowledgement

By using the Site or submitting information, you acknowledge that:

  • the Site is informational;
  • no professional engagement is created;
  • the initial submission must not contain confidential or sensitive information;
  • I may accept or reject a project at my discretion;
  • no project result is guaranteed;
  • your decisions and their consequences remain your responsibility;
  • liability is excluded or limited to the fullest extent permitted by law.
